The Industrial Commission's rulemaking function is subject to the requirements of the North Carolina Administrative Procedure Act, which provides for a uniform procedure for the adoption of rules.

Industrial Commission Periodic Review of Rules
N.C. Gen. Stat. §150B-21.3A requires all agencies to conduct a review of that agency's rules every 10 years. The Industrial Commission completed the first part of the process (periodic review report) in August 2024. On December 19, 2024, the Rules Review Commission set the date for the second part of the process (readoption of rules) as February 1, 2027.
The Industrial Commission is currently reviewing all of its rules in preparation for filing the Notice of Text in the North Carolina Register.
