The Transportation Enhancement Program (TEP)
TEP Rules and Requirements
An approved TEP project must follow developmental and implementation requirements, which include:
- Projects will be rated and prioritized by NYSDOT regional staff, the local Metropolitan Planning Organization (MPO), or both;
- Sponsors of approved projects will execute an agreement with NYSDOT stating the terms of federal reimbursement;
Project sponsor/applicant are required to comply with all applicable statutes, permits, ordinances, rules and regulations relative to federal and state law including but not limited to:
- National Environmental Policy Act (NEPA)
- State Environmental Quality Review Act (SEQR)
- American Disabilities Act (ADA)
- National Historic Preservation Act, Section 106
- Federal Aid Policy Guide
- Environmental Conservation Law, Articles 8 & 36
- Equal Employment Opportunity
- Disadvantaged Business Enterprise Participation
Sponsors must develop projects in accordance with Title 23, United States Code and the NYSDOT Project Development Manual. The NYSDOT Procedures for Locally Administered Federal-Aid Projects is the source document for project process and procedural requirements.
NYSDOT will be involved procedurally in granting technical approvals during design, right-of-way and construction phases of project implementation.
Project related work done prior to project approval and federal authorization will not be eligible for reimbursement.
The Sponsor/Applicant should be aware of these requirements to determine whether or not the Transportation Enhancement Program is the right fit for the proposed project. NYSDOT staff will be available to assist applicants and sponsors through these processes.
